Acceptable Use Policy

 

This Acceptable Use Policy is incorporated into the Agreement between Telligence Pty Ltd ACN 109 572 376 trading as Member Jungle (‘Member Jungle’) and the Customer. 

Note that any capitalised or bold terms not defined in this Acceptable Use Policy have the meanings set forth in our Terms and Conditions.

  1. Responsibility for Content & Risk
  1. The Customer is solely responsible for the selection, dissemination and use of information made available via the Services. 
  2. Member Jungle does not control or edit the content of information available in connection with the service in any way. 
  3. The Customer understands that some information may be offensive to, or leave you liable to, claims by other parties in Australian or other jurisdictions. 
  4. The Customer understands that making available some information may be illegal in Australian or other jurisdictions.
  5. The Customer warrants to Member Jungle that it is the lawful owner of or has permission from the lawful owner to publish all intellectual property published on its website that it has requested Member Jungle to host.
  6. The Customer acknowledges that there is potential risk of damage to your software, hardware or stored information through computer malfunctions, viruses or worms, to which your computer may be exposed through provision of the service.
  7. The Customer is responsible for maintaining back-up copies of stored information. 
  8. The Customer is responsible for the initiation and maintenance of any security features, software or procedures to minimise these types of risks. 
  9. The Customer is responsible for the selection and use of any security features in relation to internet transmissions. 
  1. Prohibited Activities and System Integrity

The Customer must not use the Services in any way which is illegal or which violates the rights of Member Jungle or any third party. Specifically, the Customer must not:

  1. Use the Services in any way which might interfere with, disrupt or impair the Internet, the service, the equipment or access to the service by other users.
  2. Transmit or disseminate on the Internet any viruses , phishing attempts or worms.
  3. Transmit information illegally or do any act which is illegal under any law , or make available any information which will or may leave Member Jungle liable to any civil or criminal penalty or any claim by any person or which may cause loss or damage to Member Jungle or to any person
  4. Do anything which will or may constitute an infringement of copyright.
  5. Transmit or disseminate on the Internet any material that is harassing or threatening or any material that is defamatory.
  6. Use any external API or systems to access the Member Jungle system without the express permission of Member Jungle. This includes any code that will log into Member Jungle via any automated means.
  7. Attempt to investigate, scan, or assess the security weaknesses of any network or system, or intentionally bypass or compromise security or authentication measures.
  8. Access, modify, or use restricted or non-public areas of the Service, or any shared Service area you are not expressly authorised to enter.
  9. Engage in any activity that places an unreasonable or disproportionately heavy load on Member Jungle's infrastructure or that of our third-party providers.
  10. Decompile, reverse engineer, take apart, or otherwise try to discover the underlying source code or algorithms for any component of the Service.
  11. Access, search, or create accounts for the Service using any means other than the interfaces and methods publicly provided by us (including, but not limited to, scraping, spidering, or crawling).
  12. Attempt to avoid, deactivate, remove, or otherwise defeat any technical or other protective measures put in place to secure the Service.
  13. Use the Service to distribute spam, unsolicited bulk communications, or any email that breaches the Spam Act 2003 (Cth). This also includes transmitting misleading or false source-identifying information (such as phishing or spoofing).
  14. Conduct any activity that is false, deceptive, or fraudulent, or impersonate any other person or legal entity.
  15. Use any unauthorised or fraudulent credit cards, debit cards, or other payment instruments within the Service.
  1. Enforcement and Breach
  1. Member Jungle may notify you from time to time of operating rules relating to use of the Service. The Customer agrees to observe these rules. Failure to do so will be a breach by the Customer of the Agreement entitling Member Jungle to immediately terminate the Agreement and the Service.
  2. You agree that Member Jungle, either manually or via automated security systems, can lock, cancel or remove accounts, block IP addresses and, as a final step, de-activate your website and Member Jungle system. Any costs to re-activate the accounts or Member Jungle system may be passed onto the Customer at an additional payment.
  1. Mandatory Commercial Use

The Customer must allow online membership applications, renewals and/or sales of event tickets and/or store products on the Customer Site.
